QUESTION

I need help with a dog bite and retaliation claim

Asked on Mar 26th, 2026 on Dog Bites - Florida
More details to this question:
My son was bitten by a dog at my previous place of employment. He was asked to be there as a volunteer. There were no signs visible about the dog. The injury was severe enough to cause nerve damage and lost wages. I was asked not to report it at the time because I worked there. I was retaliated against for even mentioning the dog again, thus ending my employment after they laid me off due to my persistence in trying to deal with a dangerous dog. The dog subsequently has bitten another person and was recently euthanized shortly after the last bite. I have a statement from animal control regarding the dog. I do know of at least four other bites that happened and that’s why I was very concerned that the dog was still allowed to be loose on the property which hosts small children. I hope you can help with my claim. Sincerely, L Pugeau

Dear Linda, Your son may have a 3rd party liability claim for personal injury in addition to a possible workers' compensation claim. Both claims may be investigated simultaneously. You should consult a personal injury attorney sooner rather than later to avoid any potential statute of limitation problems. Choose an experienced professional for guidance and advice before going further. We all give free consultations and if we take the case, it would be on a contingent fee basis. However, you will have to reach out, as attorneys are unable to directly solicit. Even if it is determined that your son does not have a viable personal injury claim, you should speak to a workers' compensation attorneyon his behalf  asap to avoid any reporting problems as well as a retaliatory discharge claim for yourself. You can act as guardian ad litem to file a lawsuit on behalf of your biological child for the dog‑bite injuries caused by your employer's negligence. Because you’re bringing the claim solely on your child’s behalf, not for your own injuries, workers’ compensation would not bar the case. Any recovery your son receives from the employer or its insurance carrier would be placed into a structured settlement annuity for his benefit when he reaches adulthood. This platform doesn’t allow attorneys to solicit cases, but you’re free to review our backgrounds and contact one of us here in Florida privately.
