What is the legality regarding fan made video games?

More details to this question:
Under US law, I believe it is illegal to create fan games (even if all of the assets were hand made) by the DMCA 17 USC sec 512 and also by the definition of "Fair use". As an example, if I made a game that took direct character designs from My Hero Academia (a Japanese TV show) and hand made a 3d model of one of the characters, using it as an asset in a game, would this be illegal?
