Can I get probation if I committed fraud under 1,000?

More details to this question:
Last year I got a hold of my mothers card as I ordered stuff she never found out about it. So I forgot to unsubscribe from the website and she was charged 60$ and then she found out about the purchases I made( more than once *under 700$.) and if I do get jail time can I fight it with a lawyer or should I do time. I have a partly cloudy record as in I have a record but nothing this serious.
