Is it legal in Florida for a car dealership to refuse to accept a personal check as payment in full for a new vehicle?

Yes. They are not required to accept any specific form of payment if they decide otherwise. There are dozens of reasons not to accept personal checks. The answer is simple - they will usually accept a cashiers check - so get one from your bank.

Dealership had my vehicle crushed without my knowledge or consent.

Answered a year and 2 months ago by Mark Theodore Tischhauser (Unclaimed Profile)   |   1 Answer

Its unlikely that will bear out in court. In 99% of those cases - they will prpoduce records showing that they sent multiple letters and notices telling you to get your car or they will deem it abandoned or sell it off under a mechanics lein. Generally  - just because you have a dispute with the manufacturer - you are not enitled to store your broken vehicle at a dealership for free and without thier agreement otherwise. You will likely need to hire a lawyer, typically at your expense, to review this and determine what actually happened and what if any remedies you might have. ... Read Answer

Data loss

Answered a year and 3 months ago by Mark Theodore Tischhauser (Unclaimed Profile)   |   1 Answer

Not likely. Its simply common sense any more that if you have ANYONE perform repairs of any type on your computer that YOU are responsible for making and keeping a data back up, precisely for the this reason. Adding to this 99% of such services have waivers and exclusions related to data loss and reinforce the obligation of the customer to maintain a proper back up... Read Answer

Can I sue the bank?

Answered a year and 4 months ago by Mark Theodore Tischhauser (Unclaimed Profile)   |   1 Answer

Unless you are willing to spend a lot more money than the case is worth "to make a point", I don't see a viable claim here. There are no real damages, and any issue with the restaurant should easily be cleared up by getting the bank to confirm it was thier fault and to transmit the monies owed to the restaurant owner. Bear in mind - if you sue the bank over such an issue - its also likely they will ban you from future transactions as a customer and cancel your account. In some businesses this is a significant issue that needs to be considered. ... Read Answer

Possibly. The problem with such cases is those "scammers" are usually dirtbags or junkies that spend the money as fast as they scam it from thier victims, so expectations of "getting money back" are slim. That said, this is an issue you should report to law enforcement to address from a "holding them accountable" aspect. ... Read Answer

Looking for a lawyer for Hud housing violation

Answered a year and 5 months ago by Mark Theodore Tischhauser (Unclaimed Profile)   |   1 Answer

If the eviction already occurred this would be a problem. The time to address allegations of HUD violations or an unlawful eviction is BEFORE the eviction takes place and hiring a lawyer from the beginning. I was able to look at part of your case and it seems you were removed from the property by writ of possession almost 1 year ago. It is not clear what you are attempting to do, or what result to achieve, at this point in time. You can call our office at 1-800-922-6442 to address this issue further or to provide more details.... This will all depend on the terms and conditions of the membership you signed up for. You will need to review that and cancel accordingly. You can also open a dispute with your credit card servicer and see if they will cancel the deal. It may not get you your money back, but you can also try a complaint with the Florida Attorney General.... Read Answer

You may need to hire a lawyer to sue the warranty company to replace the condensor and challege thier claim that the repairs are subject to an exclusion. You can use this service, Google or others to locate a lawyer in your area to retain. The key issue is whether a lawyer will require a pre-paid retainer or takethe case on a contingent fee. ... No unfortunately you cannot at least the legal way. However there is good news. Since you did enter the US legally, you can get a green card if you marry a US Citizen. There may be an issue if the J visa is subject to the 2 year  resident return condition.

Citing California state law rulings 3000 miles away, from 1946,  is rarely of consequence in another state. That said, you will need to immediately retain a real estate lawyer to address any access issues required for maintenance of the A/C units on the roof, if there is a controversy over maintence access. As a general rule, you will not be allowed on the roof for liability reasons nor to service your own A/C unit for the some of the same reasons and often public health issues associated with freon or R410 handling.... Impossible to tell from the facts provided as you seem in one part to state this is a storm damage issue and then in the other claim it was caused by contractors. What is clear, however, is that if the repair cost is $500.00 it is not likely productive to retain a lawyer to intervene as it will likely cost more than the amount in dispute. No harm in calling "property damage" lawyers to see if there are any angles that might get them onboard such an insurance claim or such. ... Read Answer

This depends on the actual reasons for denial. Many times the denials are legitimate exclusions to the policy. Others, based on garbage excuses trying to screw the home owner by not paying as agreed. You will need to retain a lawyer to pursue this, typicallyat your own expense due to some recent law changes. ... Read Answer

Can a RV Park that you live in all year round, charge you a site and lot fee.

Answered 2 years ago by Mark Theodore Tischhauser (Unclaimed Profile)   |   1 Answer

RV Parks have a lot more leeway than mobile home parks predominantly because they are transient facilities rather than MHP which involve homes that are effectively fixtures. The remedy generally is to relocate to another more accommodating RV park. You can also hire a lawyer to address whether the RV park is actually qualified as a MHP and subject to Fla. Stat. 723... Not sure what the question is. If its "what to do" you can file a complaint with DMV and may need to consider hiring a lawyer to intervene to try to recover the money. You may have to consider play a lawyer to intervene as most will not take such a case on a contingent fee.

how do I find an attorney who will take my case on contingency

Answered 2 years and 3 months ago by Mr. John Michael Frick (Unclaimed Profile)   |   1 Answer

Search for attorneys in or near your county with experience in consumer law.  See if they mention moving and storage companies in their profile.  Scroll down their profile to the section named "Payment Information" to see if they accept cases on a contingency fee.  If you don't find any, broaden your search to other potentially relevant areas of law like contract litigation, bailments, property damage, etc.  If you still don't find any, broaden the geographic area of your search. You won't be able to expand the geographic area very far considering the small size of your case.  A 40% contingency on a claim of $150,000 is only $60,000.  It is unlikely very many attorneys will be willing to travel very far for such a small fee.Unfortunately, there is no way on this platform to simply create a list of attorneys who accept cases on a contingency fee in a particular geographic area and only then scroll through the profiles to determine the attorney's areas of practice and experience.  ... What kind of case do i have

Answered 2 years and 6 months ago by attorney Ronald L. L Burdge   |   1 Answer
Sounds like the dealer jumped the gun for some reason and had no right to do the repo. And a repo vehicle sold without notice to the debtor usually means they can not collect anything from you for any deficiency. Here, if you were not behind and not in any breach of the finance contract then it makes no sense the bank would want all that money. To know your rigths for sure, you need to talk to a "autofraud" or "repo law" consumer lawyer near you. There are number of them listed for KY that you can find at the ConsumerAdvocate dot com website's "find a lawyer" page: L081250r062548* But act quick because for every legal right you have there is only a limited amount of time to file something in court or your rights expire and you are stuck with the situation. Good luck!... Read Answer
