QUESTION

Can I have a flag on my drivers license expunged.

Asked on Jun 28th, 2013 on DUI/DWI - West Virginia
More details to this question:
I live in Louisiana and had a DWI/DUI conviction in WV back in 1986 or 1987. When I went to renew my license in Louisiana in 2004, the DMV said there was a flag on my record. At the time of the arrest and conviction, I served my mandatory 24 hours in jail, paid $190.00 for the fine. Now when I found out about the flag, I called WV and they said I signed a registered letter that said I was to attend an approved course by the State. I don't recall that, and they would send a copy of the proof of. Rather than going through the course, I'd prefer to get the flag removed by expunging if at all possible. Thanks and will be looking forward to hearing from someone.

you cannot expunge anything your were guilty of-by plea or conviction. if by chance the WV DUI was a first time offenders program, you shouldnt have a conviction for it unless you didnt finish the program. if you blew off or didnt know about the class, it may require you to complete the class to clear up your record. call a WV attorney .
