I was terminated after finding out that my employer breached a verbal contract we made over an advance on my commission check, I asked about it and he disagreed and fired me because I would not sign the document authorizing him to withhold the advance from my paycheck instead of the agreed upon commission check. I won 2 unemployment hearings as he accused me of stealing and had no reason or evidence which justified my termination. My only argument was that he remove the monies from my commission and not my paycheck as I had already expressed financial hardship.He withheld the money anyway without my authorization. since termination i have fallen behind on bills, im now facing eviction. .
It is difficult to understand how you were harmed by your employer in these circumstances. You were apparently over-advanced on commissions. Your employer offset the over-advance against your draw. As a result, you received exactly the right amount of commissions. This is not a winning fact pattern for you. Moreover, you need to separate the issue of termination from the correct computation of your wages -- your employer had the right to terminate you for any reason or no reason at all.
