QUESTION

Do I have a legal case? Wrongful termination.

Asked on Jun 28th, 2013 on Employment Contracts - New Jersey
More details to this question:
I live in an at will employment state; however, I still feel wronged by this and would like to know if I have a legal case. I was just fired from my per diem job for "inappropriate comments" that violate their sexual harassment policy. A) I have never seen this policy. B) My comments were completed neutral and unoffensive. Furthermore, the incident occurred 4 weeks ago and two days ago I was called on the phone and told I was fired. I was never told I was being investigated and moreover I was never given an opportunity to argue my side. Finally, they refused to tell me who made the comment or what was said, provide me with termination paperwork and supporting documentation after multiple written requests ... Do I have a case and what would be the rough estimate payout?

these are difficult cases to win for two reasons. there does not need to be a 'cause for termination' in an 'at will' state. in addition, sexual harassment allegations can be difficult to defend. what was actually said ? the employer will be given broad discretion in this area, ed dimon, esq.
