QUESTION

Non-compete issue joining my employer's client

Asked on Sep 04th, 2014 on Employment Contracts - New Jersey
More details to this question:
Hi, My appointment letter has a non-compete clause, which says "If employment with the company(employer) terminates for any reason, you shall not for a period of 2 years from the date of termination, have any business dealings whatsoever, directly or indirectly or through corporate entities or associate with any client or customer of the company(employer) or any person or firm which has contacted or been contacted by the company(employer) as a potential customer or client of the company. If found in breach of this non-compete agreement you will be liable to punitive action and penalty in amount equal to loss of business profits. I'm getting an offer from my company's client client-X. Is it safe for me to join? Note: I'm on a bench for more than a month. As of now my employer trying to get some business from this client-X.

NJ does not favor 'non-compete' agreements. we would have to review the specifics of the contract and , more importantly, the details regarding you old and new employment to properly advise you.  the legal fee for the review and advice would be $1250. ed dimon, esq. 732-797-1600
