QUESTION

Should I register as an independent contractor?

Asked on Mar 07th, 2013 on Employment Contracts - New Jersey
More details to this question:
I am retired but have been working as a messenger/courier. The days or hours I work are my own. I have no written contract with this messenger company. I get paid by the job. At the end of the year I get a 1099 tax form to report my income. Recently, this messenger company informed me and others to register as an independent contractor if we are to continue working for this company. My questions: Why register now after many years? Should I register? What are pros and cons? Is this for my benefit or the company?

Independent contractor status generally protects the business, not the worker. If a business-worker relationship qualifies as independent contractor, it allows the business to avoid various wage and hour laws. Recent enforcement efforts have meant that many companies are working to ensure that their independent contractors continue to qualify, so the company does not have to provide various benefits, including a minimum wage.
