smoking in the workplace

More details to this question:
I work for a small business which is operated out of a designated room in my employers home as "the office". There is constant cigarette smoking happening there and the smoke bothers me, not to mention my clothing and hair smell daily. Do I have any rights as a salaried employee in NJ to be able to work in a smoke free area?

smoking is not permitted in the 'workplace'. if the 'workplace' is located in the home, that part of the home which is designated as the 'workplace' would be 'off limits' for smoking.  ed dimon, esq.
