Breach of contract

An oral contract is enforceable, it is just harder than enforcing a written contract.  These cases often end up in what are called "swearing contests" where each side attempts to prove the other wrong.  The plaintiff, the person claiming there is a 70/30 split, ultimately bears the burden of proof.  It can be done, but you should expect to have to go to trial (though always being open to a settlement offer).  ... Personal injury on property own jointly by four siblings

Answered 12 years and 8 months ago by Sarah Reese (Unclaimed Profile)   |   1 Answer
I'm not sure if I fully understand your question, but I believe the answer would be a hypothetical no.   Your insurance policy should cover claims for personal injuries that occur on the property and thus, you should have insurance coverage for that.  You don't always have to file a lawsuit so I would recommend trying to file a claim with your insurance company to request funds to cover for the personal injury that occurred on the farm.  If you are stating that one sibling is being sued for personal injury and it is not related on an injury that occurred on the farm, or related to the farm at all, and the sibling losses the case - it depends I guess.  Would need to know if there is any other possible insurance coverage that could cover the sibling for the losses and/or injury the sibling caused.  If the sibling losses the case and the Judge/Jury orders monetary payments, then the Court will likely evaluate the siblings assets, one of which would be considered the farm.  I'm not sure if the Judge will order that the farm be sold in order to pay for any potential judgment/damages, but I suppose its a possibility, although it would be difficult since it is owned by multiple persons.  Without more information, I'm afraid I can't provide you with a more detailed answer.  But best of luck!  NOTE: This response is general in nature and should not be considered legal advice.  No attorney-client relationship exists or is formed by this response. ...
