Legal yes, advisable NO!. The problem is nothing requires you to have insurance but, if the renter does not have it, YOUR insurance does not kick in as YOUR coverage only starts if the renter has a policy. So if an uninsured renter gets in an accident, you have no coverage. You must mandate insurance to your renters; if they claim they have a policy, you need to verify it is in force otherwise 1 accident could cost your company millions. The answer is possibly yes. In theory, your insurance claim should cover most if not all of the loss damage to your vehicle. The note holder, as the owner of an secured interest in the vehicle (it's in the Note!) gets all the proceeds from the insurance claim until their  interest is satisfied. It would depend on what your actual automobile insurance policy says.   You were likely provided with a copy of the full policy when you first applied and go the insurance.  You need to find it and read it.  Most polices contain certain exclusions which preclude payment in certain incidents.  It may not cover if it was because of a hit and run or if a tree fell on the car for instance.  Look through the policy and see if anything helps further explain why it was denied.  Also, did you ask the body shop what they told the insurance company?  They should tell you what they think happened.  Was there an accident report?  Did you provide it to the insurance company?  Were you somewhere (like in a parking lot of a grocery store) where there are surveillance cameras which can help prove what happened?  Were there witnesses to the accident? I would just try and collect more information and present it to your insurance company. Work with the insurance company to get more information as to why exactly they denied the claim and try and get more information from the body shop. It may be that your insurance company thinks that the insurance company for the care that hit you should pay. I think you can probably get this worked out, you just need more information from the insurance company on exactly why it was denied.  Ask them to explain it to you.
