My name is David Salvaggio.  I have more than 35 years of legal experience and head a law firm that devotes its practice exclusively to New Jersey Divorce and Family Law matters.  Please feel free to take a look at our Firm Website (www.salvaggiolaw.com) for further information about my firm.  The answer to your question is: There is a New Jersey statute which prohibits a custodial parent from moving out of NJ without either the consent of the other parent or a Court Order.  If your daughter doesn't get one of those things before she moves and the father files an objection with the court, your daughter may be forced to return to NJ until that issue is resolved.   Based on the facts you have given, it seems unlikely that the father would be successful.  Your daughter could just move--and bet that the father will do nothing.  However, to be safe, I would recommend that your daughter try to get something in writing from the father consenting to the move.  If he won't consent, then your daughter should "invest" in retaining a very experienced New Jersey family law attorney to properly prepare, file and serve a formal Motion with the court.         I would be happy to have a very brief telephone call with your daughter, to get a few more facts.
