Should I pay off a debt early if there is a lien already?

If you have a lien on your home and you close the sell of the home at the end of the month then the closing agent will send money to the lienholder (credit card company) to satisfy the lien.  If you pay off the lien but the lien is not removed, unless you can prove to the closing agent that the lien has been satisfied, the closing agent will send to the lienholder the funds to satisfy the lien.  Eventually the credit card company should see this as an over payment and refund to you  but that may take a few months.  At this point you will most likely be better off if you just let the closing agent satisfy the lien.... Tiina, Damage deposits in CO are a big deal, as I'm sure you have seen by reading the statute. She has responded so she has notice. My question to you is, since the statute allows for recovery of treble damages and attorney's fees, why would you take this matter to small claims court rather than hiring an attorney to handle it for you? Amanda, You are a tenant, even though you do not have a lease agreement.  Additionally, you have no responsibility to pay the mortgage directly.  You can only be put out of the house by the eviction process, by a court.  You have the right of possession until formally terminated, also since you husband is in the military we may be able to further delay the eviction process.  I recommend getting legal representation if you cannot control the situation on your own.
