I suggest you start by determining whether you have uninsured motorist coverage on your own car. If you do, the simplest thing to do is to handle your reimbursement through your uninsured motorist coverage. Then it will be up to your insurance company to sue the person who cause the accident. Whether or not they collect is not your problem because you will have already settled with your insurance company. Yes, you may sue; however, if your husband was more than 50% at fault for the accident it was completely bar his recovery. I think the answer is going to be a fact question based on the circumstances of the nearest place where it was reasonably safe for you to stop. I believe if you stopped in a reasonable distance and were not trying to escape the scene you have an argument. In this case, you have a fact issue as to whether the accident resulted from negligent operation of the vehicle or from negligent maintenance on the vehicle. If you are the responsible party due to negligent operation of the vehicle, then your insurance carrier should pay the claim for damage on the other cars.
