I think the answer is going to be a fact question based on the circumstances of the nearest place where it was reasonably safe for you to stop.  I believe if you stopped in a reasonable distance and were not trying to escape the scene you have an argument.  In these circumstances, the Court would look at the facts about the distance from the accident to the stopping point to evaluate the intent and whether the distance traveled was or was not reasonable.   www.gawrongfuldeathlawyer.com... You are entitled to be paid the fair market value of your vehicle with no deductible.  His liability insurance should pay 100% of the fair market value of the vehicle.  If this is enough to pay the lienholder, then any overage would go to you.  If there is a shortfall, you are unfortunately still obligated to  make payments to the lienholder for the deficiency unless you have insurance which covers you for the gap in value....
