This depends on a number os things.  The first step is to review all of the surveys and determine exactly where the house is located relative to your neighbor's property.  And depending on how long your house has been there, and depending on the particular nature of the use of your neighbor's property, there may be certain laws that would grant you ownership in the part of your neighbor's property where your house sits.  A local attorney could easily determine if this might be an option in your case. ... BOA is acting illegally if they seek a deficiency from your husband when he is not on the mortgage note.  Find someone in your city who has had success fighting BOA.  And write to your Congressional Representative and Senator.  They can help.  BOA is becoming a giant problem according to the number of people with similar stories.... What legal rights do I have to stop a foreclosure on a house that is in my name but is being bought by my brother?

If the mortgage is in your name then you have standing to stop the mortgage foreclosure. But you must act before the sheriffs sale. One way , although not the only way is to file A chapter 13 which will allow you to catch up the arrearages over a reasonable period of time usually 3-5 years. You will have also have to make the ongoing mortgage payments. You may have other options as well . Contact an attorney ASAP. Time is very critical as you may lose valuable rights if you delay!...
