What do I need besides medical records to prove my case?

Answered 2 years ago by Stephanie Elizabeth Emanuel (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security
I understand this is a stressful situation. Southwest Virginia Legal Aid Society (SVLAS) offers free legal services in civil cases, including Social Security disability appeals. They may be able to represent you in your case. You can also consider consulting a private attorney specializing in Social Security disability. While there may be a cost involved, they can provide expert guidance throughout the appeal process. Although we are not based in Virginia, however we do have partnerships with Document Preperation Services that can help you in navigating the process and understand your situation. Service like this they charge $250.00 If you are able to spend this amount than feel free to reach out to me so that I can give you the referral. If not you can try the legal aid society i mentioned above as well. But I think paid service is better alternative than a free service.... Read More

Do you think my chances are good for being approved

Answered 4 years and 7 months ago by attorney Steven Neil Perrigo   |   1 Answer   |  Legal Topics: Social Security
You should consult with an attorney that practices Social Security Disability law exclusively.  There are too many variables to answer your question without a deeper discussion. Consultations are free and you only pay an attorney if they win your case.

what are my chances of getting it

Answered 8 years and 10 months ago by Gerald Gregory Lutkenhaus (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security
It all depends. If you are under the care of a psychiatrist or psychologist who opines you are "disabled" and cannot function in a work environment then you have a chance of getting SSI (welfare disability). Social Security also considers if your condition is so severe that it has required numerous hospitalizations. On the other hand, if your conditon can be treated with medications and counseling, then you may not be able to get SSI if you can still do simple unskilled work in a non-stressful environment.    I base this opinion on 35 years of representing Social Security Disability and SSI claimants before the Social Security Administration. ... At 28 it can be very difficult to get disability if you retain the capacity to do any kind of work. Even if you have epilepsy that is not necessarily disablling if the spells are under control  by medication. In order to start a claim for SSI, you go to ssa.gov and complete the paperwork there that is requested. If your case is turned down, then you will want to contact a lawyer. You will need medical evidence supporting your contention that you cannot work. ... Read More

It is not clear why you need a lawyer. You indicate you are on Social Security but you have appealed the decision. If you are on Social Security, then why do you need a lawyer. You would need to provide more information about your current dispute. Most lawyers take Social Security cases on a percentage basis. This means if they win their fee is 25% of the benefits they win for you. However, if you are already on Social Security, it is unclear what you are trying to do and what you can win. This is probably why no lawyer will take your case. ... Read More
