In this situation I don't see how the insurance is going to help at all, that's why they have different levels insurance policies, if you pick the lowest level you do not get the benefits of having full insurance. I'm not even sure what type of loan your friend had, as most lenders force a party to have full insurance on a car that is alone for. In Massachusetts, you cannot sue a city or town in small claims court for small damage claims.  Unfortunately, If you wish to sue a town in Massachusetts, you will have to do so in Superior Court, and just to file a claim will cost you $280 just to get started.  From an economical standpoint, I am not sure it is worth your trouble.  My best suggestion is to go down to town hall and provide the pictures and video you have as evidence.  Steven A. The answer depends on your contingency fee agreement with your attorney.  If he or she secures the full $200,000 for you, the fee could be 1/3 of the full $200,000 or $66,666.  It could also be 1/3 of the amount after the lien is paid.  It really depends on how your contract is written.  Most of the time, it will be 1/3 of the gross recovery, which would be the full $200,000.  In addition, your attorney should try to negotiate your health insurance lien if possible in an effort to reduce the amount owed.  Any additional money would go to you.  You should also have out of pocket expenses that the attorney had to pay to prosecute your claim - costs to obtain medical records, expert fees, litigation costs, etc. These amounts come out of your settlement proceeds as well and have not been provided.
