What type of conviction will I get for a marijuana DUI?

Answered 10 years and 10 months ago by Jeff Fengcheng Yeh (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Criminal Defense
VC 23152(a), which has the same consequences as an alcohol DUI. But drug DUIs are harder to prove, since there is no statutory limit that deems a person "impaired" (like there is with alcohol). But by yourself there isn't much you can do. Time to shop for a DUI lawyer.

What type of conviction will I get for a marijuana DUI?

Answered 10 years and 10 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Criminal Defense
First things first: consult a criminal defence lawyer, who can review all the facts with you in more depth than this site can do. Your penalties ought to be much the same as ordinary OWI (=DUI). A first offence usually does not carry jail timebut the fact you were in an accident makes the penalty harsher. (A second offence will be a misdemeanor.)... Read More

Is it a DWI? If so, hire a lawyer immediately as the state has many hoops to jump through in order to prove intoxication by pot. You may completely avoid a conviction.

What type of conviction will I get for a marijuana DUI?

DUID (driving under the influence of drugs). This is similar to a DUI for alcohol. I strongly recommend that you hire an attorney to represent you immediately. If instead you just plead guilty, you will have a drug conviction on your permanent criminal record (and driving record), which will prevent you from getting a job, renting an apartment, getting federal student loans, or obtaining a regular bank loan.... Are there any attorneys that provide Pro Bono or reduced criminal defense?

The public defender agency. If the person does not qualify because of income level being too high, then how much an attorney charges is between the person and his attorney. You are not going to get an attorney to handle a murder charge as pro bono or limited fee.

What would happen if I have citation for less than 20 grams of cannabis?

Answered 10 years and 10 months ago by Thomas Edward Gates (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Criminal Defense
There is no defense. For a first offense the court generally sentence an individual to undertake a drug and alcohol evaluation and under go any treatment necessary. You will also have to pay a fine and do community service. Some cities offer a diversion program and you should consider it. Once completed with the program the charge is dropped.... Read More

You should hire a lawyer and get this relatively minor charge dismissed. By yourself you're going to get a criminal record, and it isn't worth it.

Yes, just hire an experienced attorney to represent you and your attorney will negotiate a plea bargain deal with the Prosecutor. Most likely, the marijuana charge can be dismissed or reduced to a lesser offense (such as "Littering") if you have an attorney on your side.

You will need to expunge your criminal record to remove the infractions. Until you do so, any background check will show all criminal activity.

The only way would be to have the criminal record expunged. This requires you filing a motion before the court that sentenced you.

Arrests and convictions will show up on your criminal background report. Convictions for theft and drug possession are not eligible for expungement (removal) from your criminal record. If not much time has passed since you pleaded guilty, and if you were not represented by an attorney when you pleaded guilty, it's possible to hire an attorney to withdraw your guilty plea and get petty theft & misdemeanor marijuana charges dismissed or reduced to a lesser offense, such as "Littering"...
