Absent expungement, which in WI would have had to have been granted at the time of sentencing, or a pardon, which Governor Walker will not currently grant, convictions are permanent, as is the resulting criminal record.

How do I get my civil rights back so I can go hunting again?

Answered 12 years and 6 months ago by Michael C. Witt (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
You can't. The state and federal bans on possession of firearms by convicted felons are lifetime prohibitions. In WI, if the charge you were convicted of wasn't eligible for expunction at the time of conviction, and/or expunction wasn't granted at the time of sentencing, it is not possible. Since Governor Walker has publicly stated he will not grant any pardons, in WI, you are presently out of luck.... Read More

Can a person with domestic violence record have gun rights restored?

Answered 12 years and 6 months ago by Michael C. Witt (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
No, not unless the conviction is expunged, or reopened and dismissed or amended. The provision in federal law allowing one to petition for restoration of gun rights was defunded decades ago, and is inoperable.

How can I get my civil rights back?

Answered 12 years and 6 months ago by Michael C. Witt (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Currently, you can't. There is a provision in the GCA of 1968 that allows a person in your position to petition the BATFE for the restoration of your gun rights, but Congress de-funded the process back in the 1990's, and there is simply no way for such an application to be processed. I suggest you bring this to the attention of your Congress person, and ask them to fund the BATFE's ability to process these applications.... Read More

Can I have my right to bear arms restored after a non-violent felony conviction?

Answered 12 years and 7 months ago by Michael C. Witt (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
No. Both Wisconsin and federal law prohibit you from possessing firearms, and while there is a provision in the federal law that allows one to apply to the BATFE for restoration of gun rights, Congress de-funded the processing of those applications about twenty years ago, so while the law is on the books, there is currently no way to use it....
