Once you cash the check it will be considered a settlement payment.  If you object to the settlement you need to make it clear in writing that you have not been satisfied with the settlement amount.  If I were you I would not cash the check unless you determine in writing that cashing the check will not be considered a settlemt agreement.  Good Luck... From the facts provided, it doesn't appear that you were at fault. Even if the dirt bike rider had some fault, the fact that there are serious injuries should not preclude you from seeking legal advice on your claim? What size was the truck?
