client doesn't get copy of lawyer's demand letter or know amount of demand?

Answered 10 years and 9 months ago by Kevin Rauseo (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
That is not typical. Your attorney works for you, and he or she should not be making decisions without your approval. You should insist on reviewing the demand before it is sent out.

Thankfully, neither of you were injured. And it is that lack of injuries that means you don't have a lawsuit. In addition to negligence, you need to prove damages, that the negligence caused some real harm. Consider yourself fortunate that you have no case. Any thought that fear is compensable is very attenuated. ... Read More

My friend fell and broke her foot would like to put the establishment on notice via thier insurance carrier, how do I proceed and what do I write?

Answered 14 years and 2 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
First, you can call the establishment and ask them for their insurance information to attempt to expedite the process. If they do not provide it, send a letter via certified and regular mail, giving a brief description of the accident, and asking them to contact you and provide their insurance information. Include a self-addressed stamped envelope addressed to your friend. Parenthetically, it would probably be better for your friend to call and write the letter in her name, since it is her claim. ... As a general rule, the attacker is responsible for this assault and battery.  The only way you can argue liability on the part of Home Depot is if they are responsible in some way.  If this attacker was known to frequent the area and Home Depot was aware prior, perhaps the company could have done something to prevent this.  Otherwise, I don't see this as a foreseeable event where precautions should have been made prior to the attack.  I am very sorry to hear about what happened to you.  My best suggestion is to speak with the DA's office that is handling the criminal matter (if there is one) and see if you can seek restitution from the offending party.  Best of luck.    ...
