Did you have insurance on the car? If not, then you are in serious trouble. If you had insurance, then just notify the insurance company of the accident and of the people making claims against you. The insurance company will provide you with a lawyer and will pay any settlement or judgment, as long as you cooperate with the company.... Read More

Anybody can sue anybody but the real question is can you win. You have to prove that she was driving. She does not have to prove that a thief was driving.

Can I file a complaint against a police officer who pulled me over for no valid reason?

Answered 13 years and 8 months ago by John F Brennan (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Car Accident
Yes, provide her description and badge number, if you have it, to the chief of police in the jurisdiction seeking to have her disciplined for an unwarranted stop. She was doing a random stop due to the time of the morning looking for a DUI violation which is wrong, but not unusual. As for a civil complaint, you have not mentioned any special damages and therefore it is doubtful that you have the damages necessary to support an civil action.... Read More

Fighting the ticket and winning is usually the easiest way of keeping a ticket off your driving record.  In some states, you can go to driving school in exchange for keeping a ticket off your DMV records. Consult with a traffic ticket attorney in your area for advice regarding your specific circumstance.  If the ticket is going to impair your husband's ability to get a job, then it may be well worth the money to hire a local attorney to take care of the matter for you. What do i do if i was invovled in an accident on the freeway?

Answered 14 years and 2 months ago by attorney Andrew Ronald Gillin   |   1 Answer   |  Legal Topics: Car Accident
The person responsible is the person who caused the accident on the other side of the freeway. An experience personal injury lawyer in your state can get the police report from that accident and obtain a recovery for you. My 22 year old nephew hit a pedestrian with his car a couple of months ago and had no car insurance. See the rest below.

Answered 14 years and 6 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
The chances of an experienced attorney representing your nephew for a minimal fee are slim.  Not impossible but very slim. Why?  Your nephew is apparently at fault (you didn't mention that he isn't) in a traffic collision where he apparently injured a pedestrian.  He has demonstrated a failure to be a responsible adult.  Driving without insurance is irresponsible.  It is unfair to the people he might injure.  Another point, why are you are inquiring for him.  Why isn't he seeking assistance instead of having his aunt do it for him? When attorneys handle cases pro bono or for a minimal fee (which most attorneys do both), it is usually in matters where someone needs legal assistance through no real fault of their own and/or justice cries out for a legal professional to step in to prevent a miscarriage of justice.  This is not the case with your nephew. Your nephew took a chance by not having insurance.  He wasn't lucky.  Now he will have to pay the price. John Bisnar BISNAR|CHASE, Personal Injury Attorneys www.BestAttorney.com 800-956-0123... What can i do??? i hired a lawyer on my roll over accident and he lied to me about how much pain and suffering i was entitled to

Answered 14 years and 6 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
If your attorney lied to you and relying on that false information caused you financial harm, you may have a viable malpractice claim against your attorney. Before going down that road, I suggest that you meet with the attorney and discuss your concerns.  It is more likely that there is a misunderstanding between you and your attorney.  At some point, even if you litigate, your attorney is going to have his say as to what happened.  You may as well find that out now rather than later. For an example, it is possible that the negligent driver had only $20,000 in insurance available, that the driver had no other assets (or likelihood to have anything substantial in the future) and that you did not have underinsured motorist coverage that could be collected.
