You need a lawyer immediately.  Feel free to call me.  You need a strong lawyer to fight the insurance company and get policy limits for her death.  Also, you need to determine if the wrongful party has any assets so that you may go after them to compensate for her life.  You simply cannot do this alone and must have a good lawyer. What kind of lawyer do we need?

Answered 13 years and 11 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
JOHN BISNAR I suggest that you consult with an auto accident attorney who is knowledgeable in insurance subrogation issues, does insurance defense work and is not associated in any way with the insurance company that is pursuing you. You can start your search by clicking the "Find a Lawyer" button in the upper left hand corner of this page.  You can also search the internet by Goggling "attorney insurance defense subrogation auto accident" or other such terms. Good luck! John Bisnar Bisnar|Chase, Personal Injury Attorneys Trusted Experts, Proven Results www.California-Lawyer-Attorney.com 800-956-0123  ... Read More

You would be well advised to speak to an experienced personal injury attorney in your jurisdiction.  The fact that you sustained multiple injuries in 2 separate accidents makes putting a value on your case difficult.  Ultimately, if your case went to trial, a jury would be asked to decide what your injuries were from each accident, and apportion fault to the drivers involved for each.  Valuing your claims is going to depend on the reports and expert testimony from your treating physicians and chiropractors.  Also, it is not clear to me whether you have completed your treatment, which means you could continue to incur medical expenses.  I would not discuss settlement until you have consulted with an attorney in your area.... It is difficult to answer this question with the few facts you presented.  If you were not moving at all, then the other person would be 100% at fault most likely.  However, we do not know how the other driver described the accident to his/her insurance company.  Most of the time, the insurance company will side with its insured if that person's version will allow the company to pay less to the other party.  Steven A.
