My boyfriend got arrested on a 12 year old warrant for FTA obstruction, how long can they hold him?

If he can post the bail amount, he can get out right away. If not, they will have to bring him in front of the judge in the court where is held now, within a couple of days. Once he is done with that case, they will either release him, unless the warrant is extraditable from county A to county B, in which case they will transport him to the next jail, where he will then be seen by a judge. You should get an attorney to work with you on this. He will almost certainly get out of jail sooner and spend less time there that way.... Read Answer

You really want to find a way to get this case dismissed so you do not have a theft conviction. Theft is a very ugly thing to have on your record. You should contact an attorney to help you out with this. I have been able to get almost all of these type cases of mine dismissed, often by using the payment of the civil fine from the store as a way to get the judge in the criminal court to throw the case out. The cases against you and your boyfriend are totally separate, but if they go to a jury trial, the prosecutor will most likely move to join the cases to be heard in front of the same jury at the same time.... It ultimately depends on the terms of the dismissal agreement, and what court orders were entered at the time. Generally, if someone is convicted, but the case is later dismissed after probation (i.e. deferred sentence) then the firearm rights need to be restored by separate court order. If there was never a conviction, then you firearm rights may not have been taken away. Good luck.... Read Answer
