How did the BAC become permissible in court or is it strictly based on their suspicion?

Answered 10 years and 8 months ago by John F. Brennan (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
I would need to have all of the circumstances, but your case is not a good one. There may be defenses but generally if you are in "control" of the vehicle, and your BAC was over the limit you can be charged. Have an attorney look into it but do not be over-optimistic.

How much time will one have for getting a third DUI on a suspended license?

In Wisconsin a third offense OWI carries mandatory jail time. The length of his sentence will depend on the blood alcohol content that was measured and the severity of his impaired driving. He can shorten the jail time by enrolling in a treatment program which he might benefit from for other reasons as well He needs a lawyer experienced in drunk driving defense. Good Luck. `... How much time will one have for getting a third DUI on a suspended license?

Answered 10 years and 8 months ago by Jacob P. Sartz (Unclaimed Profile)   |   5 Answers   |  Legal Topics: DUI/DWI
He's probably looking at felony charges. He's presumed innocent until proven guilty beyond a reasonable doubt. He has a right to counsel. If convicted of a felony charge, the court will look at his guideline scores and determine the appropriate sentence. People with bad criminal histories or other factors, though, may score high enough that they could be looking at prison if convicted. It all depends on the alleged circumstances. Additionally, he is looking at additional license sanctions from Department of State as well. He should either request a court-appointed lawyer or retain a lawyer.... Read More

Can I get a probation extension on my DUI?

Answered 10 years and 9 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   4 Answers   |  Legal Topics: DUI/DWI
Since courses have a lot of discretion in these matters, you can't know the outcome until you try. Ask your lawyer to file such a request. Provide him or her with documentation showing these facts as you laid them out in your question. If it works, well and good. If it does not, you'll have a visit home which probably will include some more pleasurable activities apart from a brief court appearance.... Read More

I have 2 DUIs, what is the statute of limitation to get my license back and would I still have to go to court?

Answered 10 years and 9 months ago by Michael B. Dungan (Unclaimed Profile)   |   2 Answers   |  Legal Topics: DUI/DWI
If I understand your question correctly, there is no magic time period where you automatically get your driving privileges restored simply because of the passage of a certain amount of time. You will not be going to court, you need to request a hearing with the Driver Assessment and Appeal Division of the Secretary of State. You will not be licensed to drive again, anywhere in the US, until you clear up your Michigan revocation. Whatever state you are in right now, you have probably applied for and been denied a license because of the Michigan hold and the National Drunk Driving Registry (if you are suspended or revoked in one state, no other state will license you). Michigan has a very difficult and technical process for getting a clearance of your Michigan hold, you should have any attorney experienced in the process assist, if you are denied, you have to wait a year to try again, so do it right, do it once, and be done with it.... Can I get an old DUI from 5 years ago expunged?

Answered 10 years and 9 months ago by Francis John Cowhig (Unclaimed Profile)   |   5 Answers   |  Legal Topics: DUI/DWI
In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions.

If I cosigned for a car and they got a DUI, will my insurance go up?

Answered 10 years and 9 months ago by John F. Brennan (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
It depends, if you co-signed the loan only (and hopefully have a second secured interest), probably not. If you are on the title, most probably yes. Confer with an attorney.

The first thing that will happen is that you will retain an experienced lawyer. The penalty which I think is what concerns you, depends upon a number of factors, including how many prior convictions you have had for similar offenses in the past ten years, whether there was an accident or other seriously bad driving, and nowadays, and very importantly, whether you have begun some treatment program for substance abuse....
