Usually it is not possible to get a conviction expunged from your record. Once you have a felony conviction it generally stays a conviction on your criminal history. When someone is banned from the state, or a county, that is only in effect while you are under sentence of that particular charge. Expungments are not complicated so long as your case qualifies - there is a form used which can be obtained from the Court. U start by filing it with the police dept. whom signs off on it and sends it to the DA or Solicitor - depending on whether the charge is a misdemeanor or felony - once approved there it is ready to be submitted to the GBI - cost is low (15 -25 to file with police dept and 25 to file with the GBI) if you want it done fast you might consider hiring an atty.... Unfortunately what you heard is mostly true. Georgia only allows expungement a of criminal records in very limited situations. Most expungements are granted where the person either has their case dismissed before it is ever formally accused or indicted or where the prosecutors agreed to allow expungement as part of the plea deal in the case. Some diversion programs in some counties also permit expungement upon successful completion of the program because the charges are dismissed if you complete the program. However if you are convicted of any crime in Georgia either with a plea or after a trial, you do not qualify for expungement - no matter how much time has passed since your conviction.
You should consult an honest lawyer to determine if your case may be one where expungement might work. Even in cases where it does not, there may be alternatives such as a Pardon which you may want to seek in your case. A lawyer who specializes in appeals or post-conviction relief should be able to help such as the lawyers at David West & Associates.

Typically you can find expungement forms on the website of the court. If the court doesn't have a website or it is not developed enough to contain the forms, then call the court's clerk and ask if they have forms at the courthouse. If not, then you will want to hire an attorney who will typically draft his or her own motions.
