If your daughter had a developmental disability prior to turning 18, you may be able to initiate Guardian Advocate proceedings. Guardian Advocate proceedings do not require the individual to be found incapacitated, and are much less time consuming and expensive than Guardianship proceedings. Have you tried moving your son without a guardianship? Assuming your son would be willing to move, and the hospital would release him to your care, you would only need to file for guardianship in Florida. If your son will not move to Florida or the hospital will not release him to you, you will need to contact an attorney who practices guardianship in Chicago.  You may need to file for a guardianship in Chicago to move him to Florida, and then contact a Florida attorney to transfer the guardianship to a Florida court. ... The sister can petition a court to have her brother deemed incapacitated and to have herself appointed guardian. However, she may not be aware that guardianship is a lengthy and expensive process. Additionally, there must be a finding by a three-person examining committee that the individual is incapacitated. "...take legal guardianship of brother so he could see kids regardless of R.O. Unless your parents can show that it was a fraudulent transfer and the vehicle is solely in your name, you should be able to retain the vehicle

Guardianship is a process with many steps. Who is appointed guardian depends on the situation, and what is in the best interest of the incapacitated person. The spouse is not an "automatic" choice for guardian. For example, it is possible that if adult children or other relatives contest the appointment of the spouse, that there would be a hearing on the appointment of the spouse as guardian.
