You need to write some detailed letters to Consumers, explaining the deal. Until you straighten it out, you are going to be stuck.

How can I return a used car?

Answered 10 years and 6 months ago by Francis John Cowhig (Unclaimed Profile)   |   7 Answers
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The short answer is that it will depend on how the car was sold and who you purchased it from. Was it sold "as is". Was it sold by a private individual or from a car lot. Since we do not have all the facts, it is impossible to give a completely accurate answers. I strongly suggest that you contact an experienced consumer rights attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options.... Read More

What could I do regarding deceptive business practices?

Answered 10 years and 6 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   4 Answers
Most states, including Wisconsin, have fairly robust Consumer Protection agencies, and enlisting their help can make a difference. In Wisconsin there are such divisions in the Department of Agriculture, Trade and Consumer Protection, and also the Department of Justice. You could also consult a lawyer skilled in representing consumers in disputes with businesses. There are laws that can protect you. If the other party to the contract knew you were drunk at the time of entering into the contract, for example, that could be grounds for cancelling it. There are others. A good lawyer can make a major difference and is usually worth the investment. Good Luck.... Read More

Do we have recource if someone uses us as credit reference and we are being hounded? How?

Answered 10 years and 6 months ago by Georges Herman Shers (Unclaimed Profile)   |   5 Answers
No, all she is doing is saying you can provide information as to whether she should be given any credit. Since you do not like her and will say nothing positive, doing so was not wise on her part. The people calling you should be told you are listed as a reference and not a guarantor so their bothering you beyond asking what you think of her as a credit risk is in violation of the fair credit collection laws and you are hanging up and demand they not contact you again. As to your son, he has to tell the people involved as to his security clearance, etc., that they are getting divorced and her behavior should not reflect upon him.... Read More

That depends entirely on the contract language in the document you signed. ?If it says you have to pay whether or not you use the services, you are not entitled to a refund. ?Many service businesses have this provision because they know most people will not use everything they are entitled to.?... Is a business obligated to refund payments for unused services? How?

Answered 10 years and 6 months ago by Gregory M. Janks (Unclaimed Profile)   |   6 Answers
If there was a written contract, then it will more than likely answer your question and control how a court would rule in any dispute. If there isn't a written contract, then typically either course of dealing (ie: how this business, or other similar ones, usually deal with such a situation) will control or what is fair and equitable will control. So if no written agreement, then the specific facts of the situation will be important. For a more in depth and researched answer, you would have to consult local counsel.... Read More

Which company should we file a lawsuit in and why?

Answered 10 years and 7 months ago by Georges Herman Shers (Unclaimed Profile)   |   8 Answers
Legally, your claim is only against the tow company. ?You have no claim against the insurance company which has a contract with the tow company to pay for damages it causes. ?So it is entirely irrelevant where the insurance company is located. ?If they are offering a settlement, why are you considering a lawsuit before you know their offer. ?See what it is and then you can decide if it is worth getting an attorney, do you just want advice from the attorney, a demand letter, etc. ?If you hire the attorney to handle the entire case he may charge 1/3 of the recovery so it might be cheaper to hire an attorney on an hourly rate basis, depending on how much work they have to do....
