Go see an attorney in your area immediately and make sure your child is carefully monitored. As we are seeing lately, concussions, post concussion syndrome (sounds like your daughter has this) and other maladies like benign paroxysmal positional vertigo (BPPV) are much more serious than we first thought. The liability against the store is very good and it would be a res ispa locquitur case, which will help. First and foremost, make sure your child is ok and then see an attorney.... Read More

No, you do not have to necessarily have extensive injuries to make a claim from an auto accident. I suggest that all of you immediately seek treatment for your injuries so that they can be verified and taken care of. I also suggest that you consult with an attorney to discuss the details of your situation.... Read More

I cannot answer your question about how much you and your wife's cases are worth as I would need a lot more information. Generally, a person is entitled to be "made whole" for injuries and damages sustained in a motor vehicle accident. There are a number of different items that a person is entitled to be compensated for after they have been injured. These include, but are not limited to: whether an injury is permanent; how the injury affected a person while they were recovering; medical expenses; lost wages; pain and suffering; and inconvenience. There is no "magic formula" to determine the value of a case. Each case is different and dependent on its own facts. I would not consider settling until you know whether your wife's injuries are permanent. Cases are worth more money if someone has a permanent injury. I would strongly suggest contacting a personal injury attorney to discuss your case. Most offer a free initial consultation and you can get more information about the possible value of your cases.... You do not give enough information for me to advise what to ask for. If you are doing this without an attorney, figure out what you think is fair. Ultimately, the insurance company will base any offer on its view of what a jury might award. Juries d not usually give large verdicts if the only treatment is chiropractic. Often, you can only get the med bills paid and a thousand or two above that. Sometimes, not even that.... Read More

As you know, a deposition is a sworn statement from someone who possesses knowledge about a case. Witnesses, experts and parties to a lawsuit may be some of the people who are asked to give depositions. Since I don't know your role in the law suit, I can't answer what the next step may be.

Typically, a medical provider should only be entitled to payment from a settlement for treatment RELATED to that accident. However, keep in mind that regardless of whether the bill is related or not, if you got the treatment, you are responsible for the bill!

You would need to check your states law, but you are asking about a products liability case, as in a product I am using hurt me. First, you would have to show it caused you an injury, your doctors seem to be saying there is no injury so it would be hard to pursue litigation without that element. You should consult local counsel.
Thank you,
