Verbal agreements are binding contracts, but it is easier to prove the existence and the terms of written agreements. Even if the other person admits that there was a verbal agreement, they may have a different understanding about what the agreement required. These cases often come down to who the jury or judge chooses to believe.... Read More

Is a verbal agreement considered valid?

Oral contracts are indeed enforceable in California, just as though they were written. One principal difference is that the statute of limitations for a claim based on an oral contract is two years, and the statute for a claim based on a written contract is four years. There are also certain contracts that must be in writing, pursuant to what is called the Statute of Frauds. The list of types of contracts falling within the Statute of Frauds is too complicated to explain here.... Read More

Some verbal agreements are enforceable. The statute of frauds requires contracts that deal with real property, or those which cannot be fully performed in less than a year to be set forth in writing. If you attempt to draft your own contract, be clear in the terms. Ambiguous provisions will be construed by a court in favor of the non-drafting party.... Read More

Can I file a police report or complaint to get the mechanic to finally have my car repaired?

Answered 11 years and 11 months ago by Edwin K. Niles (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
Police will not help as there is no crime. You can make a complaint to the Bureau of Consumer Affairs, but they may not help much. You could sue in Small Claims Court, but that might not get the job done, as all they can do is render a money judgment.

How do I sue the drunk driver who hit me and killed my passenger?

That is a terrible situation. Few non lawyers can resolve a case like this properly, and most law firms will do so for a reduced attorney fee.

You describe a very serious situation and you are wise to consider representation. Cases which involve drunk drivers by their very nature also then involve punitive damage issues as well as the standard compensatory issues.

That's what lawyers are for. Find a lawyer in your area who is experienced in these matters. He or she will handle it on a "contingency fee" basis, meaning that there are no up-front costs to you and if there is no recovery, you pay nothing. You can call several of them, and find out who you are most comfortable with.... Read More

How would I go on about suing a malpractice for my ruptured appendix?

Answered 13 years and 2 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   10 Answers   |  Legal Topics: Personal Injury
Well, I am NOT a California lawyer, but I am a specialist in medical malpractice, so my answer will be proper, medically but because the time limits may be different in California, you really need to consult with a lawyer there. The doctor/hospital screwed up. Appendicitis is diagnosed by pain in the right lower quadrant of your abdomen, and what is called rebound tenderness. If you had the "normal" symptoms, then the doctor should have picked up on it, especially since your kidneys are in back somewhat above your hips. The appendix was loaded with pus, and when it burst, it spread all of that throughout your abdominal cavity, and if not promptly and properly treated, you could have developed peritonitis, and you could have died. You have long term damages due to having a hysterectomy. Get a malpractice lawyer and go for it. Hopefully, the time limit has not run out. In Michigan, you have to sue within 2 years of the date of the malpractice.... Read More
