Any and all medical bills which are beyond the coverage provided by the insurance of person who hit your dad are also that person's responsibility. Your dad can sue him in civil court and hold him personally liable. In the meantime, your dad should file a claim with medicare and request them to pay for these bills. If your dad had his own auto insurance, such policy might have under-insured insurance coverage too. Your dad needs a in person consultation with a lawyer. ________________________________________... What can I do if I am without a car and the police wont serve the driver of the car who hit me?

If the statute of limitations has not expired, get a Georgia lawyer and sue. The police are not obligated to serve the papers. You have to hire the process server.

can my lawyer take a percentage from the entire amount of settlement before the bills are paid? thanks.

Usually, "yes".  Check the retainer agreement to see if the attorney's fee is based upon the "gross amount of the settlement" or the "net after paying medical expenses". We have been involved in situations where we have recovered hundreds of thousands of dollars for a client (usually policy limits and/or questioned liability) who has two to ten times that amount in medical bills.  If the attorney didn't get paid before paying medical bills there would be no attorney fee what so ever.  In those types of cases, an injured person couldn't get an attorney to collect the few hundred thousand for them if the attorney wasn't going to be paid for his work and expertise. The usual case is an attorney's fee is based upon the gross recovery, the full amount recovered. You can check with the Bar Association in RI to see if there are any special rules that apply to your specific situation. My practice is based in Massachusetts, and we have no such policy in MA regarding a set number of days allowed.  However, once the at fault party pays you the book value of your car, then its responsibility is over.  I would suggest the company would have no obligation to pay for a rental after that.  As far as the 10 days goes, I would call your own insurance agent and ask that question.  It seems unfair to me.  For example, if the at fault insurance company took 20 days to get you money for your car, I would argue you should be entitled to a rental car for the entire time.  Best of luck to you.
