You can fire your lawyer and get a new one, but you should realize that the lawyer you have may be entitled to part of the recovery if you have any, and your new lawyer will have to basically start the case all over.  Make sure you are firing your lawyer because the lawyer isn't doing the job, not because they gave you advice you don't like.  If it is because you don't like what the lawyer said, the next lawyer may come to the same conclusion and say the same thing.  ... I am a S.C. lawyer and board certified internist, but my answer does not create an attorney/client relationship, nor do I solicit clients.  More detail is needed.  If the children's names are on a deed, the property belongs to the children and whomever else is on the deed. The family court can arrange for the appointment of a guardian to act as trustee for the children until they reach the age of majority, which is 18 in S.C.  Child support is calculated based on your net worth.  The proceeds from an auto accident would be part of your net worth.  A divorce has nothing to do with child support.  These are your children, and you should be happy to provide for them.  Children are a blessing from the Lord.
