Since this has been ongoing for as long as it has, it may be time for you to have an attorney send them a letter setting forth what has happened and insisting that it not happen again.  The difficulty here is that it sounds like more of a nuisance (taking your time responding, etc.) than a real financial hardship, so you have to decide whether it is worth spending a little bit of money (several hundred dollars likely) to try to stop the problem.   Thanks,Jon... Let me get this straight.  You never ordered or paid for the item.  The seller made a mistake by shipping it to you.  It corrected hat mistake by picking up the item.  All of this cost you nothing.  Yet you think that you should get the item that you never ordered or paid for for free.  Am I missing something?  If you had sent double payment for one item by mistake, do you think the seller should be able to keep the extra money?... Is the issue $100 or $100,000?  You can sue anyone that wrongfully took the money.  You can also make a criminal complaint with the DA.

Who pays the costs depends on what the parties' arbitration agreement provides.  If silent, each side would generally bear its own costs and would share the arbitration fees equally.  I can't predict what the arbitrator will decide, but he/she will render an award deciding the issues, as opposed to a mediator who, as you said, is only empowered to try to facilitate a settlement between the parties....
