What can happen to me for being charged with driving while suspended?

Answered 10 years and 8 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
If you plead guilty to "Driving While Suspended," 12 points will be added to your Missouri driving record and your license will be revoked for 1 year. If you hire an attorney to represent you, your attorney can get your "Driving While Suspended" ticket reduced to a non-moving, no-point violation that won't affect your driving record or insurance rates. You will have to show proof that your license has been reinstated. To get reinstated, you will have to pay a reinstatement fee to the Missouri Dept. of Revenue (Dept. of Motor Vehicles) and there may be other requirements. You can't get your license reinstated if you have any outstanding unpaid traffic tickets. I suggest you call the Missouri Dept. of Revenue to ask if you are eligible for reinstatement of your license and also ask what you have to do to get reinstated.... Read More

If I was charged with a felony in one state but now live in another state can I have my felony expunged?

Answered 10 years and 9 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
You will have to hire an attorney who practices in the state where you got the felony conviction. They can tell you whether your conviction qualifies for expungement. Where you live doesn't matter.

Can I have my sale of narcotics charge expunged and get US citizenship? How?

Answered 10 years and 9 months ago by Thomas Edward Gates (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Criminal Defense
You can not petition the court to expunge your record until you have satisfied the probation terms and waited at least 2 years (for felony it is upwards of 5 years) after that date to apply. Given it being a drug charge, you will have some obstacles to over come. Yes, retaining a attorney to assist you will help.... Read More

Can I have my sale of narcotics charge expunged and get US citizenship? How?

Answered 10 years and 9 months ago by attorney Philip Daniel Hache   |   3 Answers   |  Legal Topics: Criminal Defense
A criminal defense attorney can help you with the expungement process. I can help with that if your case is in Southern California, call me at 818 336 1384. As far as citizenship, as i understand it getting the conviction dismissed (ie. expunged) can be helpful, but you should address that question with an immigration attorney. I can put you in touch with an immigration attorney if you would like.... Read More

Is it possible to get two old felonies expunged?

Answered 10 years and 10 months ago by Francis John Cowhig (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Criminal Defense
It's possible, but the felonies most likely will have to be reduced to misdemeanors first. I suggest that you contact a criminal defense attorney experienced in post-conviction relief for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options.... Read More

You need an attorney, and if one was foolish enough to provide an estimate on these facts they are really to foolish for you to want their representation. Do it right before your trouble, and costs, compound.

What is the Statute of Limitations for traffic violations warrants?

Answered 10 years and 10 months ago by Andrea Rogers (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Criminal Defense
There is no statute of limitations on old tickets. If you failed to appear in court and failed to pay the fines, the court issues a warrant for your arrest and possibly also suspends your license. Those warrants never expire. Your best option is to hire a traffic law attorney to get your warrants lifted and get the tickets reduced to non-moving, no-point violations that won't negatively affect your driving record and insurance rates. If you hire an attorney to handle this, you won't have to appear in court, but you will have to pay fines & court costs for each ticket.... Read More

Statute of limitations does not apply to cases that were filed and you did not show up for. The statute is tolled by your failure to appear.
