How do I go about getting my record sealed or expunged?

Answered 2 years and 3 months ago by Mr. Preston White (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
There is a process, depending on the charge, to vacate the charge. In the court that convicted/sentenced you, you can petition to have the charge vacated and sealed. Expungement is a different situation, and may be appropriate depending on the circumstances. What you are describing, most likely, would be a vacate/seal. You can get the forms off of the state courts website, and follow the instructions, or if you want to ease the process, you can hire an attorney to process the vacation for you.... Read More

When my record gets expunged would it be too late to become a police officer?

Answered 11 years and a month ago by Edmund P. Allen, Jr (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
So long as you stay out of trouble and do well for the next several years, I do not think that juvenile crimes from when you were 13 or 14 should be a problem for you. The hiring policies are up to the individual police department, but if you do well in school, preferably go to college and do well, they should be willing to look past it, while considering your explanation of how you turned your life around. You can probably seal the juvenile records, but you will still need to disclose these things. If you fail to disclose, and they find out on their own, then they will most likely disqualify you out of hand.... Read More

How do I fill out the paperwork to get my criminal record sealed?

Answered 11 years and 4 months ago by Edmund P. Allen, Jr (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Certain convictions can be vacated, depending on the type of crime, and the length of time since the terms of the sentence were completed. If it is vacated, then the guilty plea is withdrawn, a non-guilty plea is entered, the case is dismissed, and the conviction is vacated. It needs to be filed in the court where the conviction took place. It also needs to be served on the prosecuting attorney for that jurisdiction. I handle these for people on a regular basis.... Do I need to get my felony conviction expunged to apply to get my gun rights back?

Answered 11 years and 9 months ago by Steven Jed Alpers (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Expungements
I don't know if you can. It depends on what the charge was and if it can be reduced to a misdemeanor or not.

Shoplifting and whether or not to plead guilty?

Answered 12 years and 9 months ago by Edmund P. Allen, Jr (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
You should definitely not plead guilty. You should get a good lawyer and try to find a way to have it dismissed. Theft 3 is a gross misdemeanor, not a felony. Theft is a very ugly thing to have on your record, especially when you are applying for jobs.

Can I be charged with possession of stolen property if I wasn't the one who stole?

Answered 12 years and 10 months ago by Charles E. Rohr (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
An individual can be charged with possession of stolen property if there is reasonable grounds to believe that the person knew, or should have known, under the circumstances, that the property was stolen. Who stole the property in the first place is immaterial.

If the felony is his only conviction, misdemeanor and felonies, it can be expunged. An experienced attorney can help with the appropriate filings. Good luck!
