If so, you should open a claim on his insurnace policy for your vehicle repairs. You shoud also open a claim for bodily injury on his policy if you were injured as a result of the collision.   ... Can I sue for the insurance for bad faith?

Answered 6 years ago by Mr. Walter Joseph Gabriel, Jr (Unclaimed Profile)   |   1 Answer
Bad faith is not a given under this circumstance. But understand that you can sue for what you believe your claim is worth without specifically alleging bad faith.

You can let Esurance subrogate wherever they can (per your release) and seek reimbursement for their payments on your behalf. They will step in your shoes and pursueany viable party for their self-interest. Anything recovered beyond their payments will go to the insured(s).... Read More
