What makes a case a wrongful death case is that the outcome from the incident you are suing for resulted in death. It is very difficult to determine whether you have a viable medical malpractice case based on the facts you supplied. You need to tell the disability company that your doctor has not released you. In addition, you should probably get a statement from your doctor saying that you cannot return to work.   Be sure and do all of your correspondence with the disability company in writing so that you can have proof.  You may need to seek the assistance of a local attorney to help you if the disability company continues to refuse to pay.  The attorney will want to see your medical records and all correspondence with the disability carrier.  Good luck. Medical malpractice is a very specialized field of law. Having said that, people who handle medical malpractice cases generally handle malpractice cases of all sizes. Rather than picking your lawyer based on the size of the firm, pick the firm based on how much experience the attorneys in the firm have in prosecuting medical malpractice cases. Lawyers.com has a good site for selecting a specialty firm in your geographical area. So does Avvo, and Findlaw. These sights will direct you to the websites of specific law firms When they do, make sure the firm you are considering has a record of success in medical malpractice litigation.
