MAKE SURE YOU TAKE AND KEEP POSSESSION OF THE DEFECTIVE BRAKE CALIBER.  You should contact a local personal injury attorney (one in your state). Look for one who does products liability work. Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts (with at least a couple involving products liability claims). Please note that by attempting to answer your question, I am not acting as your attorney. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq. what kind of case do I have?

You would have a decent claim for your personal injuries.  You would not have a claim again the police officer based on the fact description you provided.  You should speak with a personal injury attorney in your area.  Most firms, including mine, offer free consultations.  Good luck going forward. Why in the state of Florida, my daughter can not find a lawyer that will return her calls. My daughter was injured.

I cannot think of any reason why an attorney would not take the case based on the facts that you are conveying, but perhaps you do not know all of the pertinent facts. First, condolences for your loss.  As a father of three I can't imagine what you're going through. You should contact a Pennsylvania personal injury attorney and run the facts by him.  He will advise you whether you have a viable cause of action for the adults failure to supervise your son.  Depending on the nature of the motorbike, there may also be a products liability claim.   Please note that by attempting to answer your question, I am not acting as your attorney. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq. Your two choices are to go through your own insurance company which would leave the problem of collecting from the at fault driver their problem, or trying to collect from him yourself. I suggest you discuss this with your insurance agent before you make a decision. It would be helpful to know whether this will impact your insurance premiums.   Good Luck... Read More
