The amount of recovery on a case like this can depend on a number of factors. The most important factor is what size policies are in play. So if the at fault driver has a minimum Oregon policy of 25K and no real assets, that might be all that is available, unless you have a good under insured motorist policy. If the at fault driver has a more significant policy, than the case can have a much more significant value, depending on the level of disability and what was lost due to the injury. Unless there is a third party involved, your sole remedy is likely to be work comp. For example, if the equipment was leased to your employer by another company, that company could be negligent for failing to provide fall protection, and thus responsible for your injuries. Your employer, on the other hand, is responsible for your on-the-job injuries regardless of whether they had any fault for your injuries. In other words, the fall could be entirely your fault, and you are still required to be compensated. The amount of compensation is usually not as favorable with a work comp claim as it is in third party liability cases, so an attorney will chose the latter if either claim is possible. Yes, it sounds like you have a case worth investigating. They probably should have performed an ultrasound to investigate the possibility of a clot.  Contact a local medical malpractice attorney (one in your state). Most personal injury attorneys work on a contingency fee basis. The standard fee is 1/3 of the gross proceeds of the settlement/award. On a case such as yours, where the other party accepted liability, you may not need an attorney at all. You may be able to negotiate the case to a reasonable conclusion yourself. However, just because the other party accepts liability does not mean that a lawyer is not necessarily needed. Most of the time the at fault party's adjuster is going to try and negotiate the case to settle for less than it is truly worth. Many of the cases that end up in trial are cases in which liability is not at issue, only value of pain and suffering. I advise many potential clients that they should attempt to negotiate the case themselves and if they are unable resolve it to their satisfaction, to come back and talk to me again. I don't want someone to pay me 1/3 of their settlement if I am not increasing the value of their case by at least that much. If by "cited" you mean you were issued a moving violation and you plead guilty or paid that ticket, you will have a very difficult time proving more than 50% fault on the other driver. However, if by "cited" you simply mean they listed you in the accident report as being at fault for failing to yield the right-of-way, then it will boil down to your word versus the other side as to who had the red light, and you might have a case. I had a similar case years ago. The buyer purchased baby oil that he put in his hair and it contained bleach or something similar. Before any lawyer can advise you on filing a claim they would need to know what in the product caused the reaction you experienced. You need the product tested to make sure it's not contaminated; if contaminated by what and was that element expected to be in the product. The manufacturer will probably as for the product for testing but I would not send it in because you'll never get it back. If you're dead set on figuring this out then pay a lab to have the product tested and determine the chemical source of your allergic reaction. Then see a lawyer.... Read More
