If the crime occurred in NY, then the NY police have jurisdiction.  Has she made any reports to the police department where the crime occurred?  The local police would take a report, investigate the case and speak with the police where the boy is located, you say Toronto.  Also she might want to talk to NY child protection as this happened in their jurisdiction.  The crime did not happen in Canada and it is logical that they would close their case.... There are a few things that you can do.  You can contact the police and tell them what happened. You can contact the program and ask that he be moved to another residence. You can notify the agency that regulates the facility.  You can sue the residence for failing to protect your son.  These are possible options. Obviously you have to consider the ramifications of each one. You have to decide whether you want to do any of them.
