Can a probation officer override a judges ordered decision for probation.

Answered 10 years and 7 months ago by attorney Julie Rendelman   |   1 Answer   |  Legal Topics: Sex Crimes
It is certainly plausible that probation can decide that you are required to do the mustard seed program.  With that said, speak to the attorney who represented you during your plea and sentence to see if there is anything that would impact probation's power to demand this.

Need an International attorney who is experienced with child sexual abuse

Answered 11 years ago by Arkady Bukh (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
If the crime occurred in NY, then the NY police have jurisdiction.  Has she made any reports to the police department where the crime occurred?  The local police would take a report, investigate the case and speak with the police where the boy is located, you say Toronto.  Also she might want to talk to NY child protection as this happened in their jurisdiction.  The crime did not happen in Canada and it is logical that they would close their case.... What would be the charges pressed against my boyfriend?

Answered 11 years and a month ago by Arkady Bukh (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
First and perhaps most importantly, the charges would have to be brought by your parents as you are a minor.  As you may or may not know the age of consent in New York is 17 and therefore this is at the very least sexual misconduct on the part of your boyfriend.  It does not appear to rise to the level of statutory rape at this point.  Yes, I know you said that you consented, however, you cannot legally do this until you are 17 years old.  It would then be up to your parents if they want to report this to the police. ... The conviction can be appealed.  If you are successful on appeal, there could be various outcomes For example, If there was insufficient evidence or verdict was against the weight of the evidence the charge could be dismissed.  If there was mistakes made by the Judge at trial the conviction would be vacated and a new trial ordered. What can I do?

Answered 13 years and a month ago by attorney Warren S. Hecht   |   1 Answer   |  Legal Topics: Sex Crimes
There are a few things that you can do.  You can contact the police and tell them what happened. You can contact the program and ask that he be moved to another residence. You can notify the agency that regulates the facility.  You can sue the residence for failing to protect your son.  These are possible options. If you are looking to sue, you may want to  speak with an  attorney before taking any further action. The sooner you decide what to do the better.... Read More
