If you are still owed any of your retroactive benefits from the time you were approved, they should be able to see that as a pending underpayment. The local SSA office is the best source for resolving your issue.  First, I would find your SSI Notice of Award and compare it to all the deposits you received that made up your back pay.  It sounds like you had a lawyer, so they would have received 25% of the back pay.  There would be no reason for them to "cheat you out of it".... How old are your parents now? What do you mean they gave their green cards back? Did they become US Citizens? I would need more info in order to properly advise you. Is your father receiving full retirement benefits?

How can a disabled person get a replacement SS card without visiting the SS office?

Answered 12 years and a month ago by Michael J. Haller, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security
The following information is on the website at social security www.ssa.gov  You can replace your Social Security card for free if it is lost or stolen. However, you may not need to get a replacement card. Knowing your Social Security number is what is important. You need a Social Security number to get a job, collect Social Security benefits and receive some government services but you do not often need to show your Social Security card. If you decide that a card is necessary, go to this link https://faq.ssa.gov/ics/support/kbanswer.asp?deptID=34019&task=knowledge&questionID=1944  The Social Security Administration has set forth simple, detailed instructions to follow.  Any originals that you submit by mail will be returned. PLEASE NOTE the following: An attorney-client relationship is not being established because of the information provided above; an in person consultation is always best when you have a legal problem; DO NOT RELY on information for a legal remedy without having contacted a lawyer; facts and circumstances of every case have to be applied to the law that is relevant for the state or location in question; NEVER rest on a right or defense you may have - legal rights are not like wine - they don't improve with age or time time limits can completely prohibit recovery; TO SEEK LEGAL ADVICE IMMEDIATELY go to http://goo.gl/cf1UM to find someone in your state.  Be sure to visit my website for answers to other Social Security Disability questions. http://haller-law.com/faq  ... i am on SSI how much can i earn without it changing my monthly income

Answered 13 years and 3 months ago by Mr. James R. Linehan (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security
Earnings trigger a trial work periodDuring a trial work period, a beneficiary receiving Social Security disability benefits may test his or her ability to work and still be considered disabled. We do not consider services performed during the trial work period as showing that the disability has ended until services have been performed in at least 9 months (not necessarily consecutive) in a rolling 60-month period. In 2012, any month in which earnings exceed $720 is considered a month of services for an individual's trial work period. In 2013, this monthly amount $750.   http://www.ssa.gov/oact/cola/twp.html... The SSA will routinely send you the same and other forms to fill out and submit, over and over.  You must do so.  Failure to do so will result in delay or denial of your claim.

Not all mistakes permit suit to be filed.  This mistake, though very personal to you, and very inconvenient, in my opinion, would not result favorably for you if you sued the SSA.  The SSA is a governmental agency that has immunity from such suits.
