Question on disabled service connected veteran getting a divorce

Your spouse is not entitled to any portion your VA disability whatsoever no matter how long you were married. To remove her as a dependent once you do get divorced follow these instructions: If you get divorced, you’ll want to notify us right away. You don’t need to send or upload supporting documents to eBenefits in this case. This will help to make sure we don’t continue paying you additional disability compensation for your former spouse and, if applicable, stepchildren after the divorce. If we continue paying you benefits that you’re not eligible for, we may withhold money from future payments until you’ve paid us back. Your other questions are way too complicated to be answered in an online forum, and no attorney can call you and offer to represent you through this forum. How can I get help reopening a claim for multiple VA disability conditions?

Hi Annette, to reopen a claim you need to file either a 526ez or Supplemental Claim depending on if the claim was previously denied (Supplemental Claim) or you're requesitng an increased rating on a disability (526EZ).  You can also do this online through eBenefits.  I would recommend you work with a Veteran Service Officer to assist you.  Most attorneys only work in appeals.  You can find a VSO at www.nacvso.org.  Once you get a decision after reopening, if you would like me to review your decision to see if you got what you were entitled to, feel free to reach out.  We do inital consultations at no charge. ... I put in for an increase for a few of my disabilities and Iโ€™m rated at 90 percent can they lower my benefits

Hi William, Unfortunately, anytime you reopen your claim and they send you for an exam you do run a risk of them lowering your percentage.  However, if you feel the disabilities have worsened then you should absolutely put in for an increase.  You can review the symptoms that put you in a higher percentage to see if you meet the criteria for higher.  This would be listed on your last rating decision, or if you want to email me what injuries you are looking for an increase I can help you find what would give you a higher percentage.  Additionally, if  you are at 90% and your disabilities are affecting your ability to work, you can put in a request to be paid at 100% due to unemployability.   Hope that is helpful! ~Amanda... What are the first steps in the process of pursuing an increase in my VA disability rating and increasing my disability benefit.

Hi Peter, if you would like to file a request to increase your 10% rating you would want to file a supplemental claim requesting an increase on the back.  You can do this online through eBenefits or file a paper form found at https://www.va.gov/decision-reviews/supplemental-claim/.  The VA will then schedule for a new exam to evaluate if an increase is warranted.  If they don't give you an increase or not enough of an increase, we would recommmend filing an appeal and working with a representative such as our office.  We would be happy to review your decision when you get it at no cost to you. ... Sounds like your case definitely needs to be looked at by the right person.  You would need to file an appeal to get those things corrected.
