There is no enough information to determine how fees should work.  Do you if suit was filed? Do you know what the expenses are.  All those issues need to be addressed before an answer or advice can be given.   Your best option is to call your attorneya nd make an appointment to come into the office and see the breakdown of all things they claim need to be paid and have it explained to you.     ... To make a claim you have to prove fault.  If the second vehicle was pushed into you, it is unlikley that you can make any claim against them.  You claims are 1: against the at fault party and 2: if the at fault party is uninsured or underinsured for your damages then agaist your own UIM insurance carrier if you have that type of coverage.    You need to reach out to an attorney in your area that handles these type of claims to see what is your best recovery avenue.    I wish you the best of luck . \... You should consult a local personal injury attorney because a local attorney can gather the necessary facts and assess damages.  Most personal injury attorneys offer a free initial consultations. This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. what is the percentage a lawyer could get from your settlement

Answered 13 years and 8 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
John Bisnar In a contingent fee situation, the percentage that the lawyer gets is generally dependant upon agreement between the client and the lawyer.  The contingent fee percentage is negotiable between the lawyer and the client in most cases.  It is not generally set by law or association. In some cases the percentage fee is going to be set by a judge after the case is concluded (in cases of minors or incompetents).  In some cases the percentage is set by law (workers’ compensation claims and some medical malpractice cases). Most personal injury contingent fee agreements are about 1/3 for cases that are not filed as a lawsuit and 40% for cases that are actually filed. Our law firm starts at a 25% contingent fee.  The percentage then goes up according to how difficult the case is, how long it is likely to take, how much the costs are likely to be, how much work is likely to be involved and the likelihood of success. This is a common problem and the law on this subject is very complex, and differs from state to state. However, it is clear that what happened is not fair. Getting a lawyer involved would cost you more than the $1500.00, so I suggest a different approach. I suggest you call you local congressperson and ask them to intervene. They have staff in their office to help people with this type of problem.  Good Luck,   Andy Gillin, Senior Partner GJEL Accident Attorneys... Read More

are police responsible for traffic accidents

Answered 14 years and 2 months ago by attorney Mr. Steven A. Schwartz   |   1 Answer   |  Legal Topics: Car Accident
You do have an obligation to allow a police car that is dealing with an emergency to pass you.  However, if you can show there was honestly nothing you could do, then that is a different story.  I suggest you contact an experienced personal injury lawyer in MS.  He or she can ask the right questions to determine whether you may have a valid claim.
