Can we get our property back?

Answered 6 years and 6 months ago by attorney Bruce Robins   |   1 Answer
You may be able to get your property back if the buyer knew or had reason to know of your option for example if you recorded it with the county clerk. as an interest in the property. If the buyer had no reason to know of your interest, however, you are probably limited to recovering money damages (the amount the value of the property exceeds $500) from your daughtee. ... Is there time limit in filing a breach of con tract lawsuit?

Answered 8 years and 9 months ago by attorney Bruce Robins   |   1 Answer
Yes, there is a time limit, but unless a shorter time was set forth in your employment agreement, I believe you would be well within it.  I don't know what the statute of limitations for breach of contract is in West  Virginia, but in most states it is between 3 to 5 years from the breach.  The problem may be that your former employer, given that it is laying people off, may not have the money to pay you even if you win your lawsuit.... If the agreement is legal, it doesn't become illegal because it was entered into by text message.  If i understand you correctly, you paid somebody to do something which was not illegal, they took the money, but haven't performed the agreement.  You can sue them for your money back or the amount of money you had to pay someone else to perform what the first party was supposed to do.  However, you can't compel them to specifically perform - a Court may order the breaching party to pay damages, but won't order them to perform a personal services contract.... I don't understand why you have waited so long to commence a lawsuit, but you should not wait any longer.  Start your lawsuit.  If you have good reason to believe that the doctors are about to leave the jurisdiction and take their assets with them, you may be able to make a motion and get the Court to grant you some interim relief to protect you, such as providing that any proceeds from the sale of the doctors' home, after secured lenders (mortgagees) are paid off, be held in escrow pending the conclusion of your lawsuit.... I do not know whether the particular Magistrate's court would have jurisdiction over this matter, but the appropriate West Virginia court should have jurisdiction.  It appears that the defendant has the requisite minimum contacts with West Virginia, having advertised in W.Va., negotiated an agreement with a W.Va. resident, and shipped goods into W.Va.  However, if you have a written agreement, you should look at what it says about jurisdiction.  Many contracts provide for an agreed jurisdiction if any dispute arises.... Most oral agreements are enforceable, and this appears to be one which would be.  You can sue your ex-friend for breach of the agreement.  You may also be able to recover what is known as quantum meruit, that is the fair market value of your services, even if you cannot prevail on the contract. ...
