As a payor of Child support can I decrease my obligation if my ex is now employed with high earnings

Answered 11 years and 2 months ago by Kevin Rauseo (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
You cannot decrease your child support on your own.  If you want to decrease child support, then you must file a petition to modify with the court.  If the child support was 3 years ago or more, then you are entitled to to have child support recalculated under NH law.  If it has not been 3 years, then you most prove the occurence of a substantial change of circumstances which makes the current order unfair.  Even if you ex agrees to reduce child support, you MUST get court approval before it is effective.  If you fail to get court approval, then the current order continues to govern child support no matter what agreement you reach with your ex. ... Answered 11 years and 3 months ago by Kevin Rauseo (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
Does the Georgia order already provide for the payment of college? UndereNH law child support ends at 18 and the court is not allowed to order the parents to pay for college.  If the Georgia orders your ex to pay for college, then NH may be able enforce it.

If a dad has 3 years left to pay child support, and he decides to retire, does the agreed upon amount necessarily change?

Answered 11 years and 3 months ago by Kevin Rauseo (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Support
Retirement, by itself, does not change the child support order.  The father would need to file a motion to modify the child support order.  If he does, you may argue that he is not entitled to a modification because he is voluntarily unemployed.  If the court feels there is insufficient justification for his retirement, then the court may attribute income to him if the court feels he is voluntarily unemployed. Please let me know if you have any other questions.  Many thanks. ... Under limited circumstances, the court may use your wife's income to calculate your child support obligation but the court must make written findings to support such an action.  When the court make such an order, it typically applies to you, not your wife.

In NH, child support is determined by a formula based on the number of children, the parent's income and certain expenses.  The formula should account for you paying the family medical insurance.  It is important that the numbers used in the formula are accurate.  The child support generated by the formula is presumed to be fair but you have the opportunity to explain to the court why the formula should not be used. ...
