Your question cannot accurately be answered without a detail review of ALL facts and the entire police file from the incident. If you have a defense to the charges (which you may); the only way to assert that defense is to take the case to trial. Simply telling the prosecutor or DA that you have a defense and then explaining your defense does nothing more then tip your hand. The DA or prosecutor would not dismiss the charges based on the assertion of the defense. Even with that, you still must fight the DMV action which is separate from the court action.... Read More

I doubt that you were never convicted of anything. My guess is that you were convicted of Impaired, or DWAI, a violation in New York and other states. Unless they could not prove you were driving you would not have been acquitted, but that is just my guess. If they were all violations you would still face bigger problems on a fourth arrest and the judge will likely give you a year on the misdemeanor if you are convicted. It is much safer, easier, cheaper, and smarter to take a taxi home if you are drunk.... Read More
