there is a provision of Tennessee law that allows a case to be expunged. However, there has to be 5 years between the date that you complete all provisions of the punishment and the date that you can file a petition to get it expunged. You say in your inquiry that you were "charged" with these offenses. I am assuming that you are asking about "convictions". Convictions where you were a minor at the time are sealed and not available to the public. For convictions where you were an adult, the "expungement" process, subject to certain exceptions, is for either a low grade felony (where the punishment received was three (3) years or less) or misdemeanor convictions, it has been five (5) years since you were released from jail, parole or probation and during that five (5) year period you have not had any new convictions. If the charge was dismissed, then there is not expungement fee. If you were placed on diversion, there is no average fee because each county charges their own separate fee and you would have to contact the court for the county where the charges occurred in and ask the clerk.

Normally, if you are asked about prior convictions, you are not legally required to disclose the expunged underage consumption. However, if I were you I would contact the board (anonymously) that licenses occupational therapists and pose the question to the board.

The length of time it takes to get a record expunged depends in large part on the court you are dealing with. I've had municipal courts schedule the expungment hearing within 2 weeks after filing. And I've had other courts take 8 months. The forms, if any, should be available on the court's website or at the court itself. If you decide to hire an attorney to take care of the practice, your attorney will most likely have his/her own motions to use.

I cannot comment on the law governing expungements in Tennessee. You really need to consult an attorney licensed to practice in that state. However, generally you are able to get a conviction expunged if it wasn't an F1 or F2 (or other violent or sexual crime). If you have more than one conviction, though, that may create difficulties in getting any convictions expunged.
