How do you know the switch was the reason for termination.

Shouldn't I be grandfathered in with my original employer, who obviously doesn't have this 7 year rule? Is my firing legal?

Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Employment
No, you are not grand fathered in Not all discrimination is illegal. Requiring all employees to have a non-interrupted work history for the preceding 7 years is not illegal discrimination. There is no "Labor Board" in Georgia. There is the Board of Review of Ga DOL, but all they do is review unemployment decisions. There is the NLRB (National labor Relations board) but all they do are union related disputes, such as strikes, organizing unions, etc. No, no lawyer can help you. You have no grounds to sue. Can I sue my CPA for filing tax late?

Answered 12 years and 2 months ago by Richard Baker, Jr. (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Employment
Professional negligence claims (which you probably had) must be brought within one year of the date of the negligence, or within one year of the time you discover the oversight. It would appear your claim would be barred by the statute of limitations, unless you did not know or have reason to know of the oversight. Otherwise, you would have a claim against this professional, and should reconsider whether that individual is the correct person to be handling your affairs in the future.... Read More

Who is responsible if a driver driving a company truck got pulled over?

Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Employment
I do not understand the question. The driver is ultimately responsible if he/she is driving without the proper credentials. The employer may share fault, but the driver is the one that gets the ticket. That is the law.

You can sue, but legal fees and costs will far outweigh the loaf of bread. Do you really want to pay $10,000 legal fees and costs to sue over a $3.00 loaf of bread?

Can a person become a finance adviser with a manslaughter record?

Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Employment
I know of no law governing "finance adviser" in general. If you are wanting to obtain a particular license, you should direct your question to the authority that issues that license. For example, if finance adviser requires you to be licensed by the Insurance commissioner, ask them this question. Other that the licensing law, I know of no law governing decisions to not hire or to discharge for falsification of an employment application, or what is lawfully required to be disclosed. What ever the employer says is final. No right to sue, no right to appeal, etc. You should look closely at the question asked, and then be truthful. I have seen valuable employees of 20+ years discharged for minor crimes that were not disclosed on the employment application. While many employees will overlook minor events, they will not overlook dishonest answers on the employment appl. When in doubt, disclose. You may receive a copy of your criminal history report. Below is from the GBI web page, http://gbi.georgia.gov/ Click "services" Obtaining Criminal History Record Information Georgia criminal history records can be obtained from local Sheriff's or Police Departments. Please contact a local Georgia agency about specific requirements for obtaining a copy of your Georgia criminal history record.... Read More
